The CCR's - Non-Compliance Process 

1.      Identifying Suspected Non-Compliance;  

• There are primarily two means of identifying suspected non-compliance in the neighborhood.  One occurs by Board member observations and the other is through home/lot owners of the Davis Trace Community.

• Board observations shall be turned over to the Compliance Review Committee.

• Home/lot owners shall report suspected non-compliance by either sending the information through the “Contact Us” page of the website @ www.davistrace.com or mailing a letter to Davis Trace Homeowners Association  P.O. Box 690064 Charlotte, NC 28227-7001.  This information will be handed over the Compliance Review Committee.

• It is important that the information provided by either a Board member or home/lot owner include; the Board member or home/lot owner’s name identifying the suspected non-compliance; the nature of the non-compliance; and the address the non-compliance is located.  It is not the intent of the Compliance Review Committee to reveal the reporting individual’s identity, but it does need that information for follow-up. 

2.       Reviewing  Suspected Non-Compliance;

• The Board shall ensure a committee, the Compliance Review Committee, exists at all times to review suspected non-compliance issues.  Members of that committee shall be well versed in the CCR’s.  Upon determination by the committee, it will issue a non-compliance notification to the appropriate home/lot owner or in the case a non-compliance violation is not found it will provide a reply to the reporting individual indicating the suspected non-compliance is not valid.

• Any home/lot owner receiving a non-compliance notification shall be given the opportunity to be heard and to present evidence to the committee whereas a final decision may be rendered.  If such a decision upholds the violation, the home/lot owner shall remedy such violation or be subject to fines in accordance with the CCR’s and NC Statues governing planned communities. 

3.      Issuance of a Non-Compliance Notification:

                All Non-Compliance Notifications will be in the following format:

   a.       Davis Trace Non-Compliance Notification Identification

          Number  XXXXXXX

   b.      Home/lot owners Name

   c.       Home/lot owners Address

   d.      Nature of the Non-Compliance

   e.       Cited Covenant, Condition or Restriction the home/lot

          owner in not in compliance with.

   f.        Date by which the home/lot owner shall remedy the violation

         or notify the committee of his or her intent to request a

         hearing.

IT IS VERY IMPORTANT TO UNDERSTAND THAT THE NON-COMPLIANCE NOTIFICATION SHALL BE MAILED VIA FIRST CLASS MAIL WITH “DELIVERY CONFIRMATION”.  ALSO THE NOTIFICATION WILL BE SENT FROM THE COMPLIANCE REVIEW COMMITTEE AND HAVE A NOTIFICATION NUMBER FOR REFERENCE.  ANY HOME/LOT OWNER RECEIVING SUCH A NOTIFICATION CAN VERIFY ITS AUTHENTICITY BY CONTACTING A BOARD MEMBER OR REQUESTEING VERIFICATION FROM THE “CONTACT US” AT THE WEBSITE.  VERIFICATON DOES NOT ALLEVIATE ANY TIME REQUIREMENTS INDICATED IN THE NON-COMPLIANCE NOTIFICATON.
